Rental Terms and Conditions

1. Scope

These rental terms and conditions apply to the rental of skis, ski boots, ski poles, snowboards, helmets, and other rental equipment from Hartl Sport Ski Rental.

2. Rental Period and Return

The rental period is agreed upon at the time of rental. The equipment must be returned no later than the agreed-upon return date during business hours. Any extension must be arranged with the rental company before the rental period expires.
Late returns may result in additional rental charges in accordance with the current price list.

3. Condition and Use of the Equipment

The customer agrees to use the equipment provided with care and in accordance with its intended purpose. Any defects or damage discovered must be reported to the rental company immediately.
The equipment may not be transferred to other persons without the rental company’s consent.

4. Theft and Loss

Rental equipment must be carefully secured against theft. Skis should be stored separately from one another whenever possible and kept overnight in a locked ski room or ski storage area.

In the event of theft or loss, the rental company must be notified immediately, and a police report must be filed. A confirmation of the police report must be presented to the rental company upon request.

The customer is liable for stolen or lost equipment in accordance with statutory provisions, particularly if the customer is responsible for the damage and no valid limitation of liability has been agreed upon.

Any theft protection coverage that may have been purchased applies exclusively in accordance with the agreed-upon terms and conditions and any agreed-upon deductible.

5. Damage to Equipment

Any damage beyond normal wear and tear must be reported to the rental company immediately. To the extent that the customer is liable under applicable law, the rental company may claim compensation for the actual damage incurred.
Normal signs of wear and tear resulting from proper use are not considered damage caused by the customer.

6. Prices and Payment

The rental rates agreed upon at the time the contract is concluded shall apply. Additional services and any other costs will be disclosed to the customer prior to the conclusion of the contract.
Payment shall be made in accordance with the payment terms posted in the store.

7. Securing and Adjusting the Equipment

Ski bindings are adjusted based on the information provided by the customer and in accordance with the relevant technical specifications. The customer is obligated to provide the necessary information completely and accurately.
Even when adjusted properly, absolute safety against release or injury cannot be guaranteed. The statutory liability provisions remain unaffected.

8. Helmets and Protective Gear

The customer is responsible for using the protective equipment provided in accordance with its intended purpose. Any damage or defects must be reported to the rental company before use.

9. Liability

The statutory liability provisions apply. Liability for personal injury or property damage is not excluded to the extent that such an exclusion is prohibited by law.

10. Final Provisions

Austrian law shall apply to the extent that it can be validly agreed upon and is not precluded by mandatory statutory provisions. With respect to consumers, the statutory provisions governing jurisdiction shall apply.
Should any individual provisions be invalid, the remaining provisions shall remain unaffected to the extent permitted by law.
